The groom and bride must go to the registry to apply for the Qualification Process for Civil Wedding at least 30 days before their scheduled wedding date.
Maximum lead time for this is 60 days.
Note: In order to get married before the 30-day period, it is necessary to request exemption of the requirement for Banns of Matrimony.
The groom and bride will need to have witnesses on two events of the civil marriage
The first is when they apply for the qualification process for marriage. On this day, the groom and bride must bring two , such as friends or relatives, other than their own parents or grandparents, who will have to bring their original ID cards. These persons will have to be prepared to attest that groom and bride have no impediment to get married.
The second occasion is for the wedding ceremony. On this day two witnesses of 18 years of age or older, who are also called best man and bride’s maid or sponsors, will be needed to bear witness to the act of matrimony. These witnesses may be the same ones that were present for the qualification process, or different ones. This is up for bride and groom to decide.
If the marriage is to take place at an outside location (referred to as in Diligence), 4 witnesses will be required.
If the marriage is to take place at the Registry, 2 witnesses will be required.
Sir,
can two foreigner get married at the cartorio?if yes. what are the procedures that would need to be followed.
What the documents to should be presented. Please enlighten me on this for two foreigners to get married in Brasil.
Hi John,
You really need to contact the Cartorio where you intend to register your marriage because a cartorio is an independent business and can ask for any documents they want.
I believe you would at least need these documents, all of which would need to be legalized at your local Brazilian Consulate.
a) Copy of your birth certificate ,Make sure your birth certificate has both your parents name on it
b) Copy of the information page from your passport.
c) Statement of single status, this document is to show you are free to marry
d) Proof of residence, this document is to prove that you live where you say you live.
After having all these documents legalized at your local Consulate or Embassy, you will need to have them all translated into Portuguese by an authorised translator.
If you are divorced you will need that document and some Catorio’s may require you to provide a criminal records document from the police, again these documents would need to be legalized in the country of origin and translated.
Finally, I believe you would have to wait for 30 days to receive authorization to marry.
The above is just off the top of my head, you really need to speak with the Catorio where you intend to marry to get the full list of documents and other requirements you need to carry out.
